Terms of Service

Please read these Terms carefully. By submitting a search request — whether through this website, by email, by telephone, or by any other means — you agree to be bound by these Terms in their entirety. If you do not agree, do not submit a request and do not engage Mr. Find It's services.
Parties and Scope of Agreement
These Terms of Service ("Terms") constitute a binding legal agreement between you ("Client") and Mr. Find It ("Company," "we," "us," or "our"), a personal sourcing and concierge search service based in South Carolina. These Terms govern every search engagement, fee transaction, and service interaction between the Client and Mr. Find It, regardless of the channel through which the request was submitted.
These Terms supersede all prior discussions, representations, proposals, or understandings — oral or written — between the parties with respect to the subject matter herein. No modification to these Terms is binding unless made in writing and expressly agreed to by Mr. Find It.
Description of Services
Mr. Find It provides personal sourcing and concierge search services for rare, discontinued, hard-to-find, and out-of-production items ("Search Services"). Upon receipt of a completed request form and payment of the applicable Search Fee, Mr. Find It will conduct a good-faith search using, as examples, a network of dealers, auction houses, private archives, estate sales, collectors, and other sourcing channels worldwide.
Mr. Find It does not manufacture, warehouse, or hold inventory of any kind. Mr. Find It acts solely as a sourcing intermediary and, where elected by the Client, as a concierge acquisition agent. The Company does not guarantee the availability, condition, authenticity, or pricing of any item identified through its search efforts.
Search Fee
A Search Fee is required before any search activity commences. The Search Fee is calculated as follows:
- Standard Rate: 12.5% of the estimated retail value of the requested item, or 12.5% of the Client's stated maximum budget, whichever is higher.
- Maximum Cap: The Search Fee shall not exceed $750.00 USD regardless of the item's estimated or actual retail value.
- Minimum Fee: A minimum Search Fee of $100.00 USD applies to all engagements.
- Custom Quote: Where no estimated value or maximum budget is provided, or where the item's value cannot be reasonably determined from the information submitted, Mr. Find It will provide a custom fee quote prior to commencing any search. No work will begin and no charge will be applied until the Client expressly approves the quoted amount in writing.
The Search Fee is earned upon Mr. Find It's commencement of active search activity. It is not contingent upon the outcome of the search except as expressly provided in Section 5 (Refund Policy).
Payment and Processing Fees
All payments are processed by a third-party payment processor. A payment processing fee will be added to the Client's total at checkout. This fee is collected directly by the payment processor and is not retained by Mr. Find It. The payment processing fee is non-refundable under all circumstances and is not included in any refund calculation.
By submitting payment, the Client authorizes the charge and acknowledges that the payment processing fee is a separate, non-refundable charge imposed by the processor and outside Mr. Find It's control.
Refund Policy
5.1 — Cancellation Within 24 Hours
A Client may cancel a request and receive a full refund of the Search Fee (excluding payment processing fees) if: (a) the cancellation request is submitted in writing to Mr. Find It within 24 hours of the original submission, and (b) Mr. Find It has not yet commenced active search activity. Cancellation requests must be submitted via the contact information provided at FindItMister.com/contact.
5.2 — Partial Refund: Item Not Located or Alternative Not Proposed
If Mr. Find It is unable to locate the specific item requested and is unable to identify and propose a suitable alternative, 50% of the Search Fee will be refunded to the Client. The remaining 50% is non-refundable and compensates Mr. Find It for the time, effort, resources, and network access expended in conducting the search, regardless of outcome.
5.3 — No Refund: Item Located or Alternative Proposed
Once Mr. Find It has located the requested item or identified and communicated what it believes in its total discretion to be a suitable alternative to the Client, the Search Fee is fully earned and non-refundable — regardless of whether the Client elects to proceed with acquisition, declines the alternative, or changes their mind about the purchase.
5.4 — No Refund: Post-24-Hour Cancellation
After the 24-hour cancellation window described in Section 5.1 has elapsed, or after active search activity has commenced (whichever occurs first), the Search Fee is non-refundable regardless of cancellation request.
5.5 — Discretionary Refunds
Any refund outside of the terms expressly stated in Sections 5.1 through 5.4 is issued solely at Mr. Find It's discretion. The issuance of a discretionary refund does not constitute a waiver of these Terms, a precedent, or an obligation to issue similar refunds in the future.
5.6 — Payment Processing Fees
Payment processing fees are non-refundable under all circumstances, including cancellations within the 24-hour window.
No Guarantee of Results
Mr. Find It makes no representation, warranty, or guarantee — express or implied — that any requested item will be located, that any located item will be available for purchase, or that any acquisition can be completed at any particular price or within any particular timeframe.
Payment of the Search Fee guarantees Mr. Find It's best-effort search using available resources and networks. It does not guarantee that the item exists in the current market, is available through any channel, or can be acquired at any price. Some items are genuinely rare, irreplaceable, or permanently unavailable. Mr. Find It shall not be liable for the unavailability of any item.
When the Item Is Found
Upon locating the requested item or a suitable alternative, Mr. Find It will contact the Client with findings, available pricing, and next-step options. The Client may then elect one of the following:
- Concierge Acquisition: Mr. Find It handles the purchase on the Client's behalf. Additional terms, fees, and a separate acquisition agreement will be presented to the Client prior to any purchase being made. The Client is under no obligation to proceed with concierge acquisition.
- Direct Introduction: Mr. Find It provides the Client with a direct introduction to the seller or source. The Client assumes full and sole responsibility for any subsequent transaction, including negotiation, payment, shipping, authenticity verification, and dispute resolution.
In either case, the Search Fee is fully earned upon location of the item and is non-refundable regardless of the Client's election or any subsequent decision not to acquire the item.
Suitable Alternatives
Where the exact item requested cannot be located, Mr. Find It may identify and propose what it believes at its total and unfettered discretion to be one or more suitable alternatives. The proposal of a suitable alternative constitutes fulfillment of the search engagement for purposes of the refund policy in Section 5. The Client is under no obligation to accept any proposed alternative. Rejection of a proposed alternative does not entitle the Client to a refund once an alternative has been communicated.
Client Representations and Warranties
By submitting a request, the Client represents and warrants that:
- The Client is at least 18 years of age.
- The information provided in the request is accurate and complete to the best of the Client's knowledge. Mr. Find It's search effort is scoped to the description provided; inaccurate or incomplete descriptions may affect search outcomes and do not entitle the Client to a refund.
- The Client is not requesting the search, sourcing, or acquisition of any item whose purchase, possession, transfer, or importation would be unlawful under applicable federal, state, local, or international law.
- The Client has the legal authority to enter into this agreement and to authorize the charges described herein.
- The Client understands that Mr. Find It is a sourcing intermediary and not a retailer, dealer, or guarantor of any item's condition, authenticity, or provenance.
Prohibited Requests
Mr. Find It reserves the right to decline any request at its sole discretion, with or without explanation, and to refund the Search Fee in full in such cases. Without limiting the foregoing, Mr. Find It will not knowingly accept requests for:
- Items whose acquisition or transfer is prohibited by law;
- Items subject to trade sanctions, export controls, or cultural property laws;
- Items whose sourcing would require Mr. Find It to engage in deceptive, fraudulent, or unlawful conduct.
Non-Circumvention
All sourcing methods, vendor relationships, network contacts, and search processes employed by Mr. Find It constitute proprietary business information. The Client agrees not to solicit, circumvent, or directly contact any source, vendor, dealer, collector, or contact identified or introduced by Mr. Find It in connection with a search engagement, except through the direct introduction process described in Section 7, for a period of two (2) years following the conclusion of the relevant engagement.
Breach of this provision entitles Mr. Find It to seek injunctive relief and damages, including but not limited to the full value of any transaction completed in circumvention of this clause.
Limitation of Liability
To the fullest extent permitted by applicable law, Mr. Find It's total liability to the Client for any claim arising out of or related to these Terms or the Search Services shall not exceed the amount of the Search Fee actually paid by the Client for the specific search engagement giving rise to the claim.
Mr. Find It shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to loss of profits, loss of opportunity, loss of data, or emotional distress — arising out of or related to the Search Services, even if Mr. Find It has been advised of the possibility of such damages.
Mr. Find It is not responsible for the actions, representations, or omissions of any third-party seller, dealer, auction house, or other source identified through its search efforts. Any transaction between the Client and a third-party seller is solely between those parties.
Indemnification
The Client agrees to indemnify, defend, and hold harmless Mr. Find It and its owners, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) the Client's use of the Search Services; (b) the Client's breach of these Terms; (c) the Client's violation of any applicable law or regulation; or (d) any transaction the Client enters into with a third-party seller identified through Mr. Find It's search efforts.
Governing Law; Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Search Services that cannot be resolved informally shall be submitted to mediation administered by a mutually-agreed-to mediator in Montana, in accordance with applicable mediation rules. Both parties are required to attend mediation in person. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending mediation.
The Client waives any right to participate in a class action lawsuit or class-wide arbitration against Mr. Find It.
Modifications to These Terms
Mr. Find It reserves the right to modify these Terms at any time, with or without advance notice. Updated Terms will be posted to this page with a revised effective date. Continued use of the Search Services after any modification constitutes the Client's acceptance of the revised Terms. It is the Client's responsibility to review these Terms periodically. Material changes will be noted at the top of this page.
Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
